PRACTICE:

Mark Burns is an attorney in private practice who concentrates his practice in the development, financing and syndication of real estate with an emphasis on multifamily housing, and mixed use properties.  In his practice he represents owners and developers in the structuring of ownership entities, including joint ventures, partnerships and limited liability companies, and the acquisition, financing and development of properties.  Mark also represents lenders in developing lending programs, structuring and documenting loans, and closing transactions.

Mark has also focused on the financing, development and preservation of affordable housing using federal, state and local incentives such as:

  1. Federal Low Income Housing Tax Credit,
  2. Illinois Housing Development Authority Risk Sharing Program,
  3. Illinois Housing Development Authority Trust Fund Program,
  4. City of Chicago Second Mortgage Program,
  5. HOME mortgage financing,
  6. Tax Increment Financing,
  7. Illinois Donation Credits, and
  8. HOPE VI financing.

Mark's representation of developers and owners includes a variety of financing structures using:

  1. tax exempt and taxable bond financing,
  2. multi layered debt financing,
  3. both conventional and HUD - insured multifamily loans, and
  4. equity investments from investor limited partners based upon the availability of the federal low income housing tax credits. 

He has represented lenders including FHA-approved mortgage bankers, not-for-profit corporations, banks and savings banks.  These lender representations have included:

  1. multi-tiered mortgage loan financings and debt participations,
  2. FHA insured multifamily loan financings,
  3. pooled mortgage loan sales and participations,
  4. credit enhancement transaction, and
  5. loan restructuring and workouts.

RELEVANT ACTIVITIES:

Mark is a member of the American Bar Association's Sections of Real Property, Probate and Trust Law, and Urban, State and Local Government Law, and the ABA Forum on Affordable Housing, and is a member of Phi Delta Phi Legal Fraternity.
